❓ What Is Total Loss?
A vehicle is declared a Total Loss when:
- The repair cost exceeds 75% of the vehicle’s Insured Declared Value (IDV)
- The vehicle is stolen and not recovered
- The damage is so severe that restoration is not economically viable
In such cases, the insurer compensates you based on the IDV minus applicable deductions like excess, depreciation, or salvage value.
π ️ Total Loss vs Constructive Total Loss
- Total Loss: Vehicle is destroyed or stolen beyond recovery
- Constructive Total Loss: Repair cost exceeds the market value, even if the vehicle is physically present
Both qualify for full payout under comprehensive insurance.
π Procedure to Claim Total Loss (2025 Rules)
- Immediate Notification
Inform your insurer within 24 hours via app, helpline, or website - File FIR (if applicable)
Mandatory in case of theft or third-party accident - Digital Documentation Upload
Submit photos of damage, FIR copy, RC, DL, and insurance policy - Surveyor Appointment
Insurer assigns a licensed surveyor within 48 hours - Assessment & Approval
Surveyor submits report; insurer approves or rejects within 3 working days - Ownership Transfer
You may need to transfer vehicle ownership to the insurer and cancel registration at RTO - Settlement
Claim is settled within 7 working days after approval.
- The owner must first close the loan with the financier.
- Only after loan closure, the financier will issue Form 35 (hypothecation termination) and NOC
- These documents are mandatory for ownership transfer to the insurer or for deregistration at the RTO
- Without Form 35, the insurer cannot take possession or settle the claim fully. Many assume the insurer will directly pay the financier—but in reality: The claim amount is paid to the registered owner, not the financier.
